These terms cover the use of RaceTrak, software for the organisers of ultra-marathons and trail races. RaceTrak is operated by Clicks and Bits Apps, a division of JEH Electronics LLC ("we"). By creating an account, buying a race credit, or using the app at an event, you agree to them.
RaceTrak records that an operator saw a runner at a checkpoint, at a time. It is a log of human observations, kept so that a race organiser can tell who is still out on the course.
It is not a safety device, a locator, or a substitute for a race's own safety procedures. It does not know where anybody is. It knows what a volunteer typed, if a volunteer was there, if they were not busy, and if the runner passed the point where somebody was standing. A runner who leaves the course between checkpoints is invisible to it. Sweeps, radio protocol, cut-off enforcement and medical planning remain the organiser's responsibility and must not be replaced by anything on this screen.
You need an account to set up a race. You are responsible for what is done with it, and for the accounts and station codes you issue to your volunteers — a station code admits whoever holds it, which is deliberate, because a tablet is shared across shifts and a login prompt at 3am in a canyon is a data-loss event rather than a security control.
To close an account and remove the personal data attached to it, write to support@racetrak.us. Records of races that have already taken place are kept by the organising body — see the privacy policy.
You decide what runner information goes into RaceTrak, and you are responsible for having the right to put it there — including telling entrants that their information will be handled this way, and obtaining any consent your jurisdiction requires. That includes emergency contacts, which reach station devices on purpose so they are available at the checkpoint where somebody is on the ground.
If you publish a race for public viewing, you are responsible for having the entrants' consent to do so, and for honouring any runner who asks not to appear.
RaceTrak is built to keep working without a network, and that is the point of it: devices record locally and sync when they can. We do not promise that the hosted parts — sign-in, the portal, the shared view — are available at any particular moment, and a race must be runnable without them. Take the printed manual and the paper backup.
Do not use RaceTrak to track people who have not entered a race, attempt to reach data belonging to races you are not a member of, or resell access. We may suspend an account that does.
RaceTrak is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability is limited to what you paid us in the twelve months before the claim.
Nothing in these terms limits liability that cannot lawfully be limited.
We may change these terms. If a change matters to you — pricing, refunds, what a credit buys — we will say so by email to account holders before it takes effect. The date at the top of this page is when it last changed.
These terms are governed by the law of the State of Idaho, without regard to its conflict-of-laws principles. The state and federal courts located in Canyon County, Idaho have exclusive jurisdiction over any dispute arising from them.
